General Terms and Conditions
1) Object
The contracts for the sale of products, stipulated remotely via computer network on the "floppypipe.it" site, are governed exclusively by these general conditions of contract.
2) Leave
These general terms and conditions exclusively govern sales contracts stipulated by consumers, meaning as such natural persons who act for purposes unrelated to any entrepreneurial or professional activity carried out and Floppy di Ricci Roberta. based in San Benedetto del Tronto (AP), in via XX settembre, 87 (VAT number 01538240449).
The purchase order made by anyone who is not resident or domiciled in one of the authorized states or by anyone who has not completed eighteen years of age is considered void.
3) Conclusion of the contract and acceptance of the general terms and conditions
The contracts for the sale of mobile telephony products or other products on the "floppypipe.it" site are considered concluded when the purchase order placed by the consumer is received by Floppy di Ricci Roberta.
Floppy di Ricci Roberta will promptly send the consumer receipt of the purchase order made by the consumer.
The consumer, by sending his purchase order electronically, declares that he has read and accepted the present general conditions of contract and undertakes to observe and respect them in his relations with Floppy di Ricci Roberta.
4) Consumer obligations
The consumer is required, before submitting his purchase order, to carefully read these general terms and conditions. The forwarding of the purchase order implies their full knowledge and their acceptance.
Finally, the consumer is required, once the online purchase procedure has been concluded, to print and keep these general conditions of contract, which have already been viewed and accepted during the phase of concluding the contract.
5) Method of purchase
The consumer purchases the product, the characteristics of which are illustrated online in the relative descriptive and technical sheets, at the price indicated therein plus the delivery costs specified on the site.
Before forwarding the purchase order, the unit cost of each selected product is summarized, as well as the total cost in the event of the purchase of several products and the relative delivery costs.
Once the purchase order has been submitted, the consumer will receive an e-mail message from Floppy di Ricci Roberta confirming receipt of the purchase order and containing information relating to the main characteristics of the purchased good, a detailed indication of the price , delivery costs, applicable taxes and means of payment and containing a reference to the general contract conditions and information about the existence of the right of withdrawal, the conditions and methods of its exercise displayed on the site. "Following the approval of the Decree Law of 4 July 2006

6) Payment
The consumer can make the payment due by choosing one of the following methods listed.
a) Payment by credit card
Payment for purchases by credit card can only be made with the following credit cards: VISA, MASTERCARD, and only by the holder/holder of the credit card.
Poste Pay cards are enabled for payment, as they belong to the Visa circuit.
The verification of the correctness of the payment data communicated by the consumer is the sole responsibility of the credit card issuers.
In the event that the consumer intends to pay by credit card, he can make use of a procedure, made available by AAAAAA and provided by Paypal/IWBank, suitable for ensuring the confidentiality of the data provided by customers. In particular, this procedure requires that credit card data be entered via Secure Socket Layer and communication between bank and shop via Secure Channel.
b) Cash on delivery
Cash on delivery is accepted only if made in cash; consequently, pursuant to and by effect of art. 1197 of the civil code, payments made by check will not be accepted.
c) Payment by bank transfer
Payment by bank transfer can be made using the following details:

In the event that payment is made by bank transfer, the purchased good will be sent to the address indicated by the consumer upon receipt of the bank accountant, therefore on average five days after the transfer has been made.
After making the bank transfer, to speed up processing times, you can send the CRO together with your order number by fax to: 0735585115 or by email to: info@floppypipe.it.
7) Delivery of products
The purchased good, together with the relative receipt/invoice, is delivered at the consumer's choice in one of the following ways.
a) Delivery made to our store.
The consumer can collect the goods purchased at the Tobacconist Floppy di Ricci Roberta in Via XX Settembre No. 87 in San Benedetto del Tronto (AP).
In the event that the consumer chooses this delivery method, the purchase order will be made available in our store. Without prejudice to the availability of the goods, the consumer will pay upon collection of the goods.
The goods will be made available to the consumer at the point of sale for the purpose of collection for seven working days.
b) Home delivery
Deliveries will be made nationally and internationally.
In the event that the consumer chooses this delivery method, the goods are delivered by courier to the address indicated by the consumer. Any specific needs must be presented to Floppy di Ricci Roberta by the consumer.
The delivery of the goods is guaranteed within a minimum of 24/48 hours on the national territory and 7/15 days for international destinations, unless the consumer has chosen the method of payment by bank transfer pursuant to art. 6, letter c) of this contract.
In the event that the consumer chooses the delivery method by courier, the payment can be made in advance by bank transfer or credit card according to the indications contained in the art. 6, letter c) of this contract and Floppy di Ricci Roberta is required to send the goods upon receipt of the confirmation of the transaction.
In the event that the consumer chooses the cash on delivery method of delivery, payment must be made exclusively in cash, to be paid directly to the courier upon delivery of the goods, and will involve an additional cost of € 4.00.
In the event of non-delivery due to the recipient's absence at the address indicated by him in the order, the courier will leave a notice and try again a second time; if the recipient is still absent, the goods will be returned to the sender (Floppy by Ricci Roberta).
8) Guarantee of conformity and defective products
The products purchased on the "floppypipe.it" site are subject to the regulations on the sale of consumer goods contained in articles 1519 bis – 1519 nonies of the civil code.
The delivered products comply with the characteristics illustrated online in the relative descriptive and technical sheets.
Floppy di Ricci Roberta is liable to the consumer for any lack of conformity existing at the time of delivery of the goods.
In the event that the delivered goods present a lack of conformity, the consumer has the right to restore the conformity of the goods.
Without prejudice to the applicability of the remaining provisions contained in articles 1519 ter and following of the civil code, the aforesaid right is recognized for the consumer provided that the delivered good has been used correctly, in compliance with its destination and with the provisions of the instructions for use that may be attached to the product purchased by him. In particular, the aforementioned guarantee does not apply to goods which present lack of conformity which the consumer was aware of at the time of conclusion of the contract or which
he could ignore by the use of ordinary diligence.
a) Terms
The consumer is required to report the lack of conformity of the goods to Floppy di Ricci Roberta within 10 days from the date on which he discovered the defect. The consumer loses the rights listed above if he does not report the lack of conformity within the indicated term.
9) Right of withdrawal
You have the right to withdraw from the contract, without giving reasons, within 14 days. The withdrawal period expires after 14 days from the day on which you or a third party, other than the carrier and designated by you, acquires physical possession of the last good. of your decision to withdraw from this contract by means of an explicit declaration (for example a letter sent by post, fax or e-mail). To meet the withdrawal deadline, it is sufficient for you to send your communication concerning your exercise of the right of withdrawal before the withdrawal period has expired.
Effects of withdrawal If you withdraw from this contract, you will be reimbursed for all payments you have made to us, including delivery costs (with the exception of additional costs deriving from your possible choice of a type of delivery other than the least expensive type of standard delivery offered by us), without undue delay and in any case no later than 14 days from the day on which we are informed of your decision to withdraw from this contract. These refunds will be made using the same means of payment you used for the initial transaction, unless you have expressly agreed otherwise; in any event, you will not incur any costs as a result of such reimbursement. The refund may be suspended until receipt of the goods or until the consumer demonstrates that he has returned the goods, whichever comes first. The direct costs of returning the goods will be at your expense.

The right of withdrawal referred to in articles 52 to 58 for distance contracts and contracts negotiated away from business premises is excluded in relation to: b) the supply of goods or services whose price is linked to fluctuations in the financial market that the professional is unable to control and which may occur during the withdrawal period; c) the supply of made-to-measure or clearly personalized goods; d) the supply of goods liable to deteriorate or expire rapidly; e) the supply of sealed goods which do not lend themselves to being returned for hygienic or health protection reasons and which have been opened after delivery; f) the supply of goods which, after delivery, are, by their nature, inseparably mixed with other goods; g) the supply of alcoholic beverages, the price of which has been agreed at the time of conclusion of the sales contract, the delivery of which can only take place after thirty days and the actual value of which depends on market fluctuations which cannot be controlled by the professional; h) contracts in which the consumer has specifically requested a visit from the professional for the purpose of carrying out urgent repair or maintenance work. If, on the occasion of this visit, the trader provides services in addition to those specifically requested by the consumer or goods other than the spare parts necessary to carry out maintenance or repairs, the right of withdrawal applies to these additional services or goods; i) the supply of sealed audio or video recordings or sealed computer software which have been unsealed after delivery; l) the supply of newspapers, periodicals and magazines with the exception of subscription contracts for the supply of such publications; m) contracts concluded at a public auction; n) the provision of accommodation for non-residential purposes, the transport of goods, car rental services, catering services or services relating to leisure activities if the contract provides for a specific date or period of performance; o) the supply of digital content through a non-material support if the execution has begun with the express agreement of the consumer and with his acceptance of the fact that in this case he would have lost the right of withdrawal.
10) Safeguard clause
The online seller declares to be aware of the criminal and/or administrative liability resulting from the sale of alcoholic substances to minors or resulting from other violations of certain age limits established by law. Therefore, in the event that the order should include products whose sale is subject to age limits, the Seller undertakes to verify, through a reliable procedure that includes a check of personal identity and age, that the orderer has reached the minimum age required
11) Express termination clause
In the event of total or partial non-payment of the purchase price of the goods, Floppy di Ricci Roberta reserves the right to declare pursuant to and by effect of art. 1456 of the civil code terminated this contract by sending a written communication to the consumer's electronic address.
12) Applicable law and competent court
This contract is regulated by the Italian law. Any dispute relating to the stipulation, interpretation, execution or termination of this contract will be referred to the exclusive jurisdiction of the judge of the place of residence or domicile of the consumer, if located in the territory of the State.
13) Referral
For anything not expressly provided for in this contract, the rules of Italian law in force apply.
